This offer is the Provider's proposal to conclude an agreement on the terms below. By using the service or paying for it, the user accepts these terms.
Service — the debussy.pro website, which creates a musical composition, a score and a video from a photo. User — a person who uses the service. Photo (snapshot) — an uploaded photograph and everything created from it. Feed — the shared section of the website where a user can publish their photo. Profile — the user's page on the website with their photos and purchases. Remix — a new composition from an already uploaded photo in another genre or with other settings (“knobs”).
The Provider gives access to the service. Free of charge and without registration: creating music from your photo; listening in full in the free styles (Orchestra, Piano, Baroque Fugue); the first 20 seconds in the other styles; downloading 20-second fragments (MP3, MIDI, video with a watermark); viewing the feed.
“This photo” — 149 ₽: the full version of the composition of one photo, full MP3 and MIDI downloads, video without a watermark.
“Pro” — 349 ₽ for 7 days: all styles and full versions for any photos.
“Producer” — 549 ₽ for 7 days: everything in “Pro”, plus the “knobs” (mood, light, tension, colour, dissonance, sharpness, space, melody volume) and genre switching for finished music; one version is kept per photo — a new one replaces the previous.
“Excellence” — 799 ₽ for 7 days: everything in “Producer” and up to 10 saved versions for each photo.
A plan's term starts at the moment of payment. There is no automatic renewal. Buying the same plan again extends it by 7 days. When a higher plan is bought while a lower one is active, the unused whole days of the lower plan are credited towards the price at its daily cost (a started day counts as used); the lower plan then ends, and the higher plan starts at the moment of payment. The final price with the credit is shown before payment.
Invitations: for each new user who came via an invite link and created their first music, the inviter gets 1 day added to the active plan — no more than 7 days for all invitations. If there is no plan, the days are added when a plan is bought. Days for invitations are not exchangeable for money and are not credited towards the price of a higher plan.
Payment by bank card and other methods via the internet acquiring of TBank JSC. The service is considered rendered at the moment access is opened. The receipt is sent to the e-mail given at payment. The Provider applies the patent tax system; no VAT is charged. Paid services are intended for adult users or users with the consent of their parents (legal representatives).
Money for services rendered is not refunded. The service — opening access to digital content — is considered fully rendered at the moment access is opened (section 4). The service is run by one person, without a finance or legal department, and is provided “as is” (section 12), so there are no refunds for other reasons — a change of mind, not liking the music, not using a plan until the end of its term.
The exception is when access did not open due to a technical error or the money was charged twice: write to debussy.pro@mail.ru — we will open access or refund the money within 10 business days. This section does not limit the user's rights expressly provided by law.
You can use the service and pay without signing in: photos and purchases are then tied to the browser where they were made. To open them on another device, you can sign in with VK ID or Yandex ID. On sign-in, the VK or Yandex account number, the first name (without surname) and the profile photo are stored — without e-mail, phone or friends list. You can sign out in the profile; purchases stay in the account and open again after you sign in.
The profile is private: only the user sees it until they make it public. Publishing to the feed, liking, commenting and deleting your photos are available after signing in.
Only the person who uploaded a photo can publish it in the feed. A published photo is seen by all visitors of the website: the photograph, the music, the score, the author's name and profile photo. A photo can be unpublished at any time from its menu in the profile.
Any signed-in user can like a published photo and leave a comment. Likes and comments are made on behalf of the user: their name and profile photo are shown next to the comment. A comment can be deleted by its author and by the author of the photo.
Any visitor who has access to a photo (in the feed or via a link shared by the author) can listen to it and make a remix — a composition from the same photo in another genre, and with the “Producer” or “Excellence” plan — with other settings. A remix is saved as a photo of the person who made it and uses the author's photograph. By publishing a photo or sharing a link, the author agrees to this.
The user uploads only photos they have the right to use and is responsible for their content. If there are people in a photo, it may be published in the feed with their consent. It is forbidden to upload and publish materials that violate the law or the rights of others, as well as offensive comments.
The Provider may, without notice, unpublish a photo, delete a photo or a comment and restrict access to the service if these terms are violated or as required by law. You can report a photo or a comment via the “Write to the author” form on the website or by e-mail at debussy.pro@mail.ru.
Music and video are free to distribute. Compositions, scores and videos created in the service may be freely used and distributed by the user — published, sent, inserted into their videos and projects, including for commercial purposes — without a licence, the Provider's permission or royalties. Crediting debussy.pro is not required. The Provider claims no rights to the created compositions and videos. Full versions can be downloaded within the paid scope (free — 20-second fragments). The rights to an uploaded photograph remain with its author; when publishing a video with a photograph, the user is responsible for having the right to use it.
An uploaded photograph and everything created from it (composition, score, video) are stored on a server in Russia. Until the user signs in with VK ID or Yandex ID, a photo is kept for 30 days from upload and then deleted automatically; a photo published in the feed — while it is in the feed and for 30 more days after it is unpublished. After signing in, the user's photos are kept indefinitely — including those uploaded before signing in, if they have not been deleted yet. The deletion date (if there is one) is shown in the profile next to the photo. The user can delete their photo at any time from its menu in the profile (after signing in); deletion is irreversible. Purchased full versions are available while the photo is stored.
An unpublished photo is available only via its link. The address of a photo contains a random identifier of 32 hexadecimal characters (about 5 × 1036 combinations) — it is practically impossible to guess. Whoever receives the link sees the photograph and the composition, so share it only with those you want to show the photo to. Photos, videos and photo pages are closed to search engine indexing; link previews in messengers and social networks where the user sends the link themselves still work.
Photos are used only for the operation of the service: creating music and showing it as described above. The Provider does not sell or share photos with third parties and does not use them to train neural networks. The acquiring bank TBank JSC receives only the payment data and the e-mail for the receipt — without photos. The exception is cases expressly provided by law (for example, a request from an authorised state body).
The service processes: photos (there may be people in them), the e-mail for the receipt, the e-mail and text of messages from the “Write to the author” form, sign-in data from VK ID or Yandex ID (account number, name, profile photo), the technical browser code by which the service recognises the user, the history of purchases and invitations, technical server logs (IP address, request time). The data is stored on a server in Russia and used only for the operation of the service, payments and communication with the user. Photos are not used to identify people. The service is provided “as is”. The Provider tries to keep it working without interruptions and errors but does not guarantee this and is not liable for interruptions caused by failures of equipment, the network or third-party services, nor for the created music meeting the user's expectations. The music is created automatically by an algorithm; the same photo in the same style with the same settings always sounds the same.
The service is made by one person — ИП Пучкин Вячеслав Витальевич: development, support, algorithms, design, legal matters, promotion and everything else. So a reply to a request may take some time.

The Provider may change the terms of the offer; a new version takes effect from the moment it is published on this page. Purchases paid before a change remain valid on the previous terms until the end of their term.
